Consumer Guarantee & Fair Trading Acts
We are committed to meeting our obligations under the New Zealand Consumer Guarantees Act 1993 (CGA) and the Fair-TradingAct (1986), and as such must provide you with a product(s) that;
· Is of acceptable quality, in good working order and free from defects
· Is fit for the purpose it was purchased for
· Matches the description given or sample provided
· Arrives in a reasonable time and in good condition
· Makes it clear to potential buyers that we are in trade
· Ensures any representation we make about the product(s) are accurate and do not mislead or deceive consumers
· Does not mislead consumers about their rights and obligations
· Does not engage in unfair sales practices
· Has a reasonable basis for any claims we make about our product(s)
· Complies with the product safety and consumer information standards where relevant
· Is not prohibited by an unsafe goods notice
YOUR RIGHTS
Consumer law states customers can get a replacement, repair or refund for:
· faulty products
· substandard services
· late deliveries
· being overcharged if the price wasn’t set beforehand
We do not have to give a refund, repair or replacement if the customer:
· changes their mind
· breaks it accidentally or on purpose
· doesn’t follow product use instructions or advice
· takes it elsewhere to be fixed before coming to us
In the unlikely event that a product you have purchased from Emergency Cards Limited meets one of the qualifying criteria above we are committed to meeting our obligations under the New ZealandConsumer Guarantees Act 1993 (CGA). Please contact us on contact@emergencycards.co.nz to let us know, we may require that the product(s) to be returned to us (at our cost) for further investigation. Where proven, Emergency Cards Limited at their discretion, will replace it free of charge or provide a full refund. Refunds will be direct credited into a nominated bank account.
WHAT WE WILL DO
Once the product is returned, we will try to determine the cause of the problem and the best way to remedy it with the least inconvenience and delay to you. We will work with you to resolve the matter as quickly as possible and to your satisfaction. In order to seek a remedy under the Consumer Guarantees Act, Emergency Cards Limited may need to collect and share your personal information for the purpose of arranging a replacement with a third-party provider. Please refer to our Privacy Policy for full details as to the type of information that we may collect, use, hold and share.
COMMERCIAL OR BUSINESS
The Consumer Guarantees Act may not apply to goods and services purchased from Emergency Cards Limited for commercial, resale or trade use.
